Was 49’ers Aldon Smith drinking at scene of alleged assault by Ray McDonald?

The San Francisco 49ers cut Ray McDonald when it was revealed he was being accused of sexual assault. The team’s reason was said to be a pattern of bad decision making.

So what happens when another 49’er with a “pattern of bad decision making,” ends up with his name connected to another tricky situation?

Aldon Smith was reportedly at Ray McDonald’s home when the alleged assault took place according to an affidavit. Not accused of being involved in the incident, its being reported that he was drinking the whole day. The problem with that, Smith is on probation for a 2013 DUI.

According to Tracey Kaplan of the San Jose Mercury News, the woman claimed McDonald sexually assaulted her at his home after she passed out by his pool. But she them claimed to have stayed at the house, drinking with Smith and McDonald.

Police have also seized home surveillance cameras and McDonald’s cell phone as part of their investigation.

No, Aldon wasn’t doing anything illegal. But the potential for something bad to happen, coupled with Aldon’s history with alcohol isn’t a good look. Aldon’s agent says the allegations of his drinking are false.

Smith has been given quite a few breaks by the team. He’s also extremely talented. People will watch closely how this is handled.
