Cowboys WR Roy Williams Is Suing Former Miss Texas Brooke Daniels For An Engagement Ring

I’m trying to decide if I think a marriage proposal by mail is incredibly sweet or just plain dumb. I guess the key to that answer is it depends on if I was accepting the ring correct?

Cowboys WR Roy Williams (not to be confused with former Cowboy/current Bengal Safety, Roy Williams) has filed a lawsuit against the 2009 Miss Texas USA, Brooke Daniels to retrieve the ring he sent to her when he proposed via mail shortly before Valentine’s day this year.

According to a court affidavit signed by Williams, he sent the ring in the mail to Daniels along with a recorded proposal. The proposal came as a pre-Valentine’s Day surprise along with $5,000 for bills and a baseball for Daniels’ brother. Daniels rejected the proposal and failed to return the ring.

It gets better, Daniels allegedly gave the ring to her father, Michael Daniels to hold because, even though she rejected the proposal, Roy told her to keep the ring.

“He said (to Brooke Daniels), ‘I’m not like a lot of people, I don’t want the ring back. You’ll eventually come back to me,’ and she didn’t,” Michael Daniels claimed

The father has been named as a defendant in the suit as well but he’s indicated he’ll return the ring (valued at $76,000) in order to avoid a the lawsuit.

According to Texas law, Engagement rings fall under the conditional-gift rule. As applied by Texas courts, the conditional-gift rule contains an element of fault.  Texas courts have held that the conditional-gift rule operates to require that the engagement ring be returned to the donor upon termination of the engagement, if the donee is at fault in terminating the engagement. If the donor is at fault, the ring doesn’t have to be returned.

The two lived together for about a year but it sounds as if they weren’t “together” when Roy proposed. I believe if you aren’t accepting the proposal, you should return the ring. If she had accepted and then HE broke it off, that’s a different story.

Awwww poor Roy and no rookie to torment and take his frustrations out on because of the lockout. Maybe that’s why he was so shady with Dez Bryant last season. Home life issues. What??? I’m totally joking.
